A BILL
To establish the Special Court for Public Integrity to prosecute high-ranking federal, state, and local elected officials, as well as declared candidates for such offices, who knowingly make false statements of material fact to the public on television or broadcast media.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the "Truth is required for understanding from municipal to President Act."
SECTION 2. ESTABLISHMENT OF THE SPECIAL COURT FOR PUBLIC INTEGRITY.
(a) Establishment.—There is hereby established an independent judicial body within the federal judiciary to be known as the Special Court for Public Integrity (hereinafter referred to as the "Court").
(b) Composition.—
1. The Court shall consist of 9 judges appointed by the President, by and with the advice and consent of the Senate.
2. Judges shall serve staggered terms of 10 years to ensure political neutrality and independence.
SECTION 3. JURISDICTION AND COVERED INDIVIDUALS.
(a) Covered Individuals.—This Act applies to any individual holding, serving in, or officially registered/declared as a candidate for election to any of the following positions:
• President or Vice President of the United States
• Members of the cabinet or other duly appointed representatives of the president
• Member of the United States Senate or House of Representatives
• State Governor or Lieutenant Governor
• Local elected representative (including mayors, city council members, and county executives)
(b) Jurisdiction.—The Court shall have exclusive original jurisdiction over civil and criminal proceedings brought under Section 4 of this Act.
SECTION 4. PROHIBITED ACTS & ELEMENTS OF THE OFFENSE.
(a) Offense Defined.—It shall be unlawful for any covered individual to knowingly and willfully make a statement containing a material falsehood during a televised or publicly broadcasted appearance, interview, address, debate, or campaign advertisement.
(b) Required Elements.—To establish a violation, the Special Prosecutor must prove beyond a reasonable doubt that:
1. The statement was made publicly via television, live stream, or broadcast media.
2. The statement was factual in nature, rather than an expression of opinion, prediction, or rhetoric.
3. The statement was false at the time it was made.
4. The covered individual had actual knowledge of the statement’s falsity at the time of utterance.
SECTION 5. APPOINTMENT OF SPECIAL PROSECUTORS.
(a) Independent Appointment Authority.—To ensure multi-branch oversight and prevent single-party bias, a Special Prosecutor authorized to investigate and bring charges under this Act may be independently appointed by any of the following authorities:
• The Special Court for Public Integrity, by a majority vote of its sitting judges.
• The Congress of the United States, pursuant to a joint resolution passed by a majority vote in both the Senate and the House of Representatives.
• The President of the United States, via executive order.
• Any individual member of the Cabinet, within their discretion and relevant subject-matter jurisdiction.
(b) Powers and Autonomy.—Any Special Prosecutor appointed pursuant to subsection (a) shall exercise independent prosecutorial discretion, possess full subpoena power, and have direct standing to file charges before the Court without interference from other executive or legislative entities.
SECTION 6. PENALTIES AND REMEDIES.
Any covered individual found guilty of violating Section 4 shall be subject to:
1. Fines.—A mandatory civil penalty of not less than $50,000 per violation.
2. Public Retraction.—A court-ordered, televised retraction broadcast during prime-time hours on major network channels.
3. Disqualification and Ineligibility.—For repeated or severe violations, forfeiture of office, removal from the electoral ballot, and temporary or permanent disqualification from holding any office of public trust.
SECTION 7. SEVERABILITY AND CONSTITUTIONAL SAVINGS CLAUSE.
If any provision of this Act or its application to any person or circumstance is held invalid under the United States Constitution (including Article I Speech or Debate Clause protections or First Amendment guarantees), the remainder of the Act shall remain in full force and effect.
